1. Definitions
In these Terms of Service (the “Terms”):
- “WeenGrave”, “we”, “us” and “our” mean the operator of the website available at https://weengrave.co.uk and any related online features and services we make available through that website (together, the “Site”).
- “User”, “you” and “your” mean any person who visits, accesses or uses the Site, whether or not registered.
- “Account” means an account created by a User to access certain features of the Site.
- “Content” means any text, images, graphics, logos, audio, video, software, data compilations, and any other information or material appearing on or made available through the Site.
- “User Content” means any Content that a User uploads, posts, publishes, transmits or otherwise makes available on or through the Site.
2. Acceptance of These Terms
By accessing or using the Site, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the Site. If you create an Account, you also confirm that you have the legal capacity to enter into a binding agreement with us.
If you are using the Site on behalf of a business, you warrant that you are authorised to bind that business, in which case “you” includes that business.
3. Use of the Site
We grant you a limited, revocable, non-transferable and non-exclusive licence to access and use the Site for your personal, non-commercial use or for legitimate internal business purposes in accordance with these Terms.

- misrepresent your identity or affiliation, or impersonate another person or entity;
- submit User Content that is unlawful, defamatory, infringing, obscene, offensive, misleading or otherwise objectionable.
4. Accounts and Security
To use certain features, you may need to create an Account and provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your Account. You must promptly notify us of any suspected unauthorised use or security breach. We may suspend or terminate your Account if we reasonably believe these Terms have been breached.
You must be at least 18 years old to create an Account or to place orders through the Site. If you are under 18, you may use the Site only with the involvement of a parent or legal guardian.
5. User Content
You retain ownership of your User Content. By submitting User Content on or through the Site, you grant to WeenGrave a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt, publish, translate, publicly display and otherwise use such User Content solely for the purpose of operating, improving and promoting the Site and our services. You warrant that you have all necessary rights and permissions to grant this licence and that your User Content does not infringe any third-party rights or violate applicable law.
We may monitor, moderate, remove or disable access to any User Content at our discretion if we reasonably believe it breaches these Terms or is otherwise objectionable, without obligation to provide prior notice.
6. Intellectual Property
The Site and all Content (excluding User Content), including but not limited to the “WeenGrave” name, trademarks, logos, domain name, designs, layout, look and feel, text, graphics, compilations and software, are owned by or licensed to WeenGrave and are protected by intellectual property and other rights under applicable laws. All such rights are reserved.
Nothing in these Terms grants you any ownership rights in the Site or Content. You may print or download extracts for your personal use and for legitimate internal business use only, provided that you do not modify the material and that you retain all proprietary notices. Any other use is prohibited without our prior written consent.
If you believe that any Content on the Site infringes your intellectual property rights, please contact us using the channels indicated on the Site with sufficient details for us to identify and address the alleged infringement.

The Site may contain links to third-party websites or integrate third-party services. We do not control and are not responsible for third-party content, privacy practices or terms. - We shall not be liable for any loss of profits, sales, business, revenue, contracts, anticipated savings, data, goodwill or any indirect, special or consequential loss or damage.
- Where you use the Site for business purposes, our total aggregate liability arising out of or in connection with the Site and these Terms, whether in contract, tort (including negligence) or otherwise, shall be limited to £100.
You agree to indemnify us and hold us harmless from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the Site, or your infringement of any third-party rights, except to the extent caused by our own negligence or breach.

WeenGrave is the controller of personal data collected through the Site. We process personal data in accordance with applicable data protection laws, including the UK General Data Protection Regulation and the Data Protection Act 2018.

Sections that by their nature should survive termination shall do so, including Sections 6 (Intellectual Property), 9 (Warranties and Disclaimers), 10 (Liability), 11 (Personal Data), 16 (Applicable Law and Jurisdiction) and 17 (Miscellaneous).
14. Changes to the Site and to These Terms
We may update and improve the Site from time to time. We may also revise these Terms to reflect changes in the Site, our practices or the law. The latest version will be posted on the Site with the effective date shown at the top. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Site.

16. Applicable Law and Jurisdiction
These Terms, their subject matter and their formation are governed by the laws of England and Wales.
If you are a consumer resident in the United Kingdom, you and we agree that the courts of England and Wales will have non-exclusive jurisdiction, which means that you may bring a claim in your local courts in Scotland or Northern Ireland. If you are a business, you and we irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction.
17. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and us in relation to your use of the Site and supersede any prior agreements or understandings.
- No Waiver: A failure or delay by us to exercise any right or remedy under these Terms shall not operate as a waiver of that or any other right or remedy.
- Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
- Assignment: You may not assign, transfer or sub-license any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to another organisation, for example in connection with a merger or transfer of business.
- Third-Party Rights: No person other than you and us has any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.
- Headings: Headings are for convenience only and do not affect the interpretation of these Terms.
